BevLauncher is an AI-powered design tool created for beverage entrepreneurs, businesses, and creatives to generate product mockups, packaging designs, labels, and branding assets. The platform allows users to create visual concepts which can be further refined for professional or production-ready use. BevLauncher is not a replacement for professional design services or legal advice related to intellectual property or trademarking.
3. Eligibility
You must be at least 18 years old and have the legal authority to enter into these Terms of Use to access and use the Service. If you are using BevLauncher on behalf of an organization, you represent that you are authorized to act on behalf of that entity.
4. License and Access
4.1 License Grant
We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use BevLauncher for personal or business purposes, in accordance with these Terms.
4.2 Restrictions
You may not:
- Modify, distribute, or create derivative works of BevLauncher or any content available through the Service.
- Use the Service for any illegal or unauthorized purpose.
- Reverse engineer, decompile, or attempt to extract the source code of our platform.
- Reproduce or exploit any part of the Service without our express written permission.
5. User Responsibilities
5.1 Accuracy of Information
You are responsible for ensuring that the information you provide through the Service is accurate, complete, and up to date. BevLauncher is not responsible for the results of inaccurate or incomplete information inputted by users.
5.2 Proper Use of the Service
You agree to use BevLauncher only for lawful purposes and in compliance with all applicable laws and regulations. You are solely responsible for the content and designs you generate using the Service and for any legal liabilities arising from their use.
6. Intellectual Property
6.1 Ownership
All content, software, and materials provided on BevLauncher, including but not limited to text, graphics, logos, icons, and images, are the exclusive property of BevLauncher or its licensors. You may not use any of our intellectual property without our prior written consent.
6.2 User-Generated Content
By using BevLauncher to create designs or generate content, you retain ownership of the content you create. However, by submitting content through the Service, you grant BevLauncher a worldwide, non-exclusive, royalty-free license to use, reproduce, and display the content for the purposes of operating and promoting the Service.
7. Mockup and Design Limitations
7.1 Purpose of Generated Content
The designs and mockups generated by BevLauncher are intended for conceptual and brainstorming purposes only. While these mockups are helpful in visualizing product branding, they are not production-ready assets. Users are encouraged to collaborate with professional designers to refine and finalize designs for commercial use.
7.2 Professional Refinement
For print-ready packaging, labels, or final branding assets, users should export the generated designs and work with professional freelancers or agencies to prepare these designs for manufacturing or public distribution.
8. Payments and Pricing
8.1 Subscriptions and Fees
Access to certain features of BevLauncher may require payment of fees, including subscription services. By selecting a paid service, you agree to pay BevLauncher all applicable fees as described for that service. We reserve the right to modify pricing and subscription models at any time, with reasonable notice provided to users.
8.2 Payment Terms
All payments are due at the time the Service is provided. If payment fails, we may suspend your access to the Service until payment is successfully processed.
9. Termination and Account Suspension
9.1 Termination by You
You may terminate your account at any time by contacting us or through your account settings. Upon termination, your access to the Service will be disabled, and any unused features or data will no longer be available.
9.2 Termination by Us
We reserve the right to suspend or terminate your account if you breach these Terms of Use, engage in fraudulent activities, or for any reason, with or without notice. Upon termination, we will have no further obligation to provide you access to the Service.
10. Disclaimer of Warranties

The mockups and designs generated by BevLauncher should not be considered professional advice. We are not responsible for ensuring that the designs comply with industry standards or intellectual property laws. You should consult with a professional designer or legal advisor before finalizing and using any designs created on the platform.
11. Limitation of Liability
To the fullest extent permitted by law, BevLauncher and its affiliates will not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to errors in design, misinterpretation of features, or issues related to third-party design services.
12. Indemnification
You agree to indemnify, defend, and hold harmless BevLauncher from any claims, liabilities, damages, or expenses arising out of your use of the Service or violation of these Terms.
13. Changes to the Terms of Use
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the website. It is your responsibility to review the Terms periodically. Continued use of the Service following any changes signifies your acceptance of those changes.

These Terms will be governed by and construed in accordance with the laws of Massachusetts, without regard to its conflict of law principles.
